California: Los Angeles County Enacts Ban the Box
Effective September 3, 2024, the Los Angeles County Fair Chance Ordinance for Employers will protect job applicants and employees who are applying for a promotion with their current employer, who have a criminal history, and are seeking work in the unincorporated areas of Los Angeles County. The ordinance will cover employers located or doing business in the unincorporated areas of Los Angeles County with five or more employees worldwide, including the owner(s), management, supervisorial employees, and independent contractors.
Conducting a criminal background check or asking about an applicant’s or employee’s criminal history information will be voluntary unless legally required, and neither can be solicited until after a conditional job offer is made. Employers intending to review an individual’s criminal history information after a job offer will be required to give notice with specific details about what will be reviewed and why. Employers won’t be able to ask about criminal history while waiting for a review, even post-job offer, and certain criminal history is off limits completely (like arrests that don’t lead to conviction, etc.).
Like other ban the box laws, employers will be required to individually assess all relevant facts before making hiring or employment decisions that would negatively impact an applicant or employee. Additional notice, antiretaliation, and recordkeeping requirements will apply. Employers will also be required to post ordinance notices in the workplace and online in English and any other languages spoken by at least 10% of their workforce.
Every employer shall post, in a conspicuous place at any workplace or jobsite within unincorporated areas of the County of Los Angeles where any worker works, a notice informing workers of their rights under the Fair Chance Ordinance for Employers.
Voting Rights Notice
California requires the notice to be posted at least 10 days before the November 5 election—which is October 26, a Saturday. If you’re closed on Saturdays, we recommend posting or sending this notice by Friday the 25th. California’s notice can be found in English here and in other languages here.
