Chicago’s New Paid Leave and Paid Sick Leave Ordinance effective July 1, 2024

Chicago’s Paid Leave and Paid Sick Leave (Amended) Ordinance, which was initially delayed in December 2023, becomes effective July 1, 2024. The Ordinance entitles Chicago employees to earn up to 40 hours of paid leave per 12-month accrual period and up to 40 hours of paid sick and safe leave per 12-month accrual period. This new law brings the prior Chicago Paid Sick Leave ordinance in line with the paid leave requirements under Illinois’ Paid Leave for All Workers Act. Paid leave may be used for any reason, whereas paid sick and safe leave may be used for the same reasons employees were entitled to paid sick leave under the City’s prior ordinance.

During the delay, the ordinance was amended to define a covered employee as someone who works 80 hours in the city within 120 days and to require that employers provide their written paid time off policy to each covered employee in their primary language.

Action Items

  • Update leave policies.
  • Display required posters in the workplace once available.
  • Update payroll processes.
  • Train managers/supervisors and other appropriate personnel on leave requirements.

Further information and guidance will follow. The Chicago Business Affairs and Consumer Protection Department is expected to provide additional guidance and the required notices/posters mentioned. Please note: this includes the Paid Sick Leave ordinance in effect through June 30th.
