Termination Pay Law
Beginning August 1, 2024, Louisiana’s law regarding wage payments at termination will be updated to clarify that commissions, incentive pay, and bonuses are payable to terminated employees only if at the time of separation, they are earned and haven’t been modified by a written policy.
The updates also clarify that employers are permitted to do any of the following:
- Have a policy that adjusts the amount of an employee’s commission if the order generating the commission has been changed
- Have a policy that commissions, incentive pay, or bonuses are not earned until the employer receives the payment that generates these amounts
- For bonuses that are based on the employee’s or employer’s financial performance on a periodic basis (for example, annually or quarterly), to take up to 120 calendar days after the period ends to determine if a bonus is due and the amount
Meal Breaks for Minors Updated
As of August 1, 2024, the law requiring meal breaks for minors will only apply to minors who are 15 years old or younger.
