Biometric Information Privacy Act Amended
Effective August 2, 2024, Illinois has updated the definition of written release in its biometric data privacy law to include an electronic signature. An electronic signature is an electronic sound, symbol, or process attached or associated with a record that the employee adopts and uses with the intent to sign. The amendment makes it clear that employees can execute electronic signatures to allow the collection of their biometric data.
Worker Freedom of Speech Act
Illinois passed the Worker Freedom of Speech Act, which prohibits employers from discharging or disciplining employees who refuse to attend mandatory employer-sponsored meetings if the meeting is designed to communicate an employer’s position on religious or political matters.” Similar to Hawaii, political matters include an employee’s decision to “support any . . . labor union.” The law was effective July 31, 2024.
